The prosecutor of the International Criminal Court (ICC), Karim AA Khan KC, has submitted an application for arrest warrants against Israeli Prime Minister Benjamin Netanyahu and Hamas leader Yahya Sinwar, citing alleged war crimes. The application also includes Israeli Defence Minister Yoav Gallant and senior Hamas officials Mohammed Diab Ibrahim al Masri (known as Deif) and Ismail Haniyeh.

Khan’s application, announced on Monday, is grounded in the ongoing Israel-Hamas war in Gaza. He accused the Hamas leaders of bearing criminal responsibility for war crimes and crimes against humanity, detailing a list of alleged offenses including taking hostages and committing acts of sexual violence.

“We submit that the crimes against humanity charged were part of a widespread and systematic attack against the civilian population of Israel by Hamas and other armed groups pursuant to organisational policies. Some of these crimes, in our assessment, continue to this day,” Khan stated.

The ICC, based in The Hague, has been investigating Israel’s actions in the occupied territories for the past three years, recently expanding its focus to include actions by Hamas. The investigation covers events from at least October 7, 2023.

Netanyahu has denounced the possibility of senior Israeli officials joining the ICC’s wanted list, calling it “an outrage of historic proportions.”
